50 States in 500* Days - Delaware Athlete Agent Regulation

Yeah okay, it's supposed to say "50 States in 50* Days", but who am I kidding, the new title is closer to reality. The 50 States in 50* Days series takes us to Delaware, the first of the original 13 states to ratify the US Constitution.

Delaware has also adopted the Uniform Athlete Agent Act. The Delaware Uniform Athlete Agents Act includes the formation of a Board of Athlete Agent Examiners. The Board of Athlete Agent Examiners consists of 5 members appointed by the Governor, 2 public members and 3 members who are athlete agents. Delaware is also nice enough to post its Fee Schedule online and its application for athletic agent regulation is similar to those found in other states.

Like most of the other states that regulate athlete agent activity, Delaware requires agents to retain records for a set period of time. Agents are required to keep each of the following for a period of 5 years (other states have different time period requirements):

  • The name and address of each person represented by the agent,
  • Any agency contract entered into by the agent, and
  • Any direct costs incurred by the agent in the recruitment or solicitation of a student-athlete.

These records must be made available to the Board for inspection during business hours.
