Attorneys as Athlete Agents

Darren Heitner of SportsAgentBlog.com has written a post entitled Professional Responsibility and Ethics in which he discusses the difficulties faced by attorney-agents when it comes to Rules of Professional Conduct. 

Darren intends to go through the entire Model Rules of Professional Conduct and dissect how they may be applicable to athlete agents.  Check out Darren's initial post and be sure to follow his analysis as it progresses. 

In August, Geoffrey Rapp of  the Sports Law Blog, tipped us off to an Interesting New Paper on Sports Agent Ethics by attorney Melissa Neiman on Sports Agent Ethics, Fair Game: Ethical Considerations in Negotiation by Sports Agents

As I pointed out in January, for those attorneys licensed in California who are acting as agents, California Business and Professions Code Section 6106.7 states, "It shall constitute cause for the imposition of discipline of an attorney within the meaning of this chapter for an attorney to violate any provision of the Miller-Ayala Athlete Agents Act."  

The ethical issues faced by attorney-agents have received attention in a number of law review articles and will continue to to be the focus of articles and papers so long as there is a different standard for attorneys.
